BY COUNCILOR GILBERT:
RESOLVED, that the city of Duluth does hereby authorize acceptance of reimbursement from DEDA for certain Baywalk construction expenses related to Building N in the amount of $298,900; said funds to be deposited into Fund 0255.
FURTHER RESOLVED, that the proper city officials are hereby authorized to enter into a Baywalk easement agreement substantially in the form of that on file in the office of the city clerk as Public Document No. __________, with Building N, Inc., in the amount of $118,500, payable from Fund 0255.
FURTHER RESOLVED, that Resolution 04-0039 adopted January 26, 2004, is hereby repealed in its entirety.
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize acceptance of reimbursement from DEDA for Baywalk construction costs related to Building N in the amount of $298,900, which includes reimbursement to the owner of up to $118,500 for a portion of the costs related to demolition of a lean-to structure, construction of a new wall, and certain concrete work. The resolution also authorizes a Baywalk easement agreement with Building N, Inc. pursuant to which the property owner will grant a recreation and public walkway easement to the city.
Additionally, Resolution 04-0039 which accepted reimbursement of a lesser amount from DEDA for construction expenses and authorized a Baywalk easement agreement with Building N is rescinded in its entirety. Since the passage of that resolution, the costs have increased and the terms of the easement have been substantially revised.
The construction of this segment of the Baywalk will add approximately 320 additional feet to the Baywalk. When this segment is completed, the Baywalk will connect the pedestrian lift bridge to the southeastern edge of the waterfront plaza property (the Meierhoff property). The city will be responsible for maintaining the Baywalk.
