BY COUNCILOR STOVER:
The city of Duluth does ordain:
Section 1. That the city of Duluth hereby dedicates to the general public an easement for street and roadway purposes over the following described property in St. Louis County, Minnesota, and to execute all documents necessary thereto:
All that part of Lot 8, Block 90, Duluth Proper Third Division; lying southeasterly of the following described line: beginning at a point on the west line of said Lot 8 distant 94 feet south of the northwest corner of said Lot 8; thence in a northeasterly direction 78.1 feet more or less to a point on the east line of said Lot 8; said point distant 34 feet south of the northeast corner of Lot 8, and there terminating.
Section 2. That the city of Duluth hereby dedicates to the general public an easement for snow storage purposes over the following described property:
Across and upon all of the northerly ten feet of said Lot 8.
Section 3. That upon recording of the easements granted pursuant to sections 1 and 2 above in the office of the county recorder for St. Louis County, Minnesota, the proper city officials are hereby authorized to sell and convey the following described property in St. Louis County, Minnesota, by quit claim deed, to Edna M. Davis for $1,890, to be deposited in General Fund 0100-700-1448-4640, and to execute all documents necessary with regard to said conveyance:
All of Lot 8, Block 90, Duluth Proper Third Division according to the recorded plat thereof. Excepting and reserving to the state of Minnesota, in trust for taxing districts concerned, all minerals and mineral rights, as provided by law.
Subject to easements and encumbrances of record.
Section 4. That this ordinance shall take effect 30 days from and after its passage and publication.
STATEMENT OF PURPOSE: The purpose of this ordinance is to authorize the dedication of a street and utility easement over the southeasterly portion of Lot 8, Block 90, Duluth Proper Third Division. Additionally, the northerly ten feet of Lot 8 will be reserved by the city for winter snow storage due to dead end Eighth Street therefore allowing street plowing equipment adequate space for turning and maneuvering.
Since Lot 8 has been owned by the city for many years, no previous actions have taken place to formalize the Mesaba Avenue street easement across Lot 8. Once both easements have been recorded, Lot 8 will be sold via direct sale to the adjacent property owner (Edna M. Davis) as Lot 8 is unbuildable.
TAX BASE IMPACT SUMMARY
The tax impact of this transaction will be deminimus.
