AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 17 AS CONTAINED IN THE APPENDIX TO CHAPTER 50 TO PROVIDE FOR THE RECLASSIFICATION FROM S-1, SUBURBAN, TO R-1-A, SINGLE-FAMILY RESIDENTIAL, PROPERTY LOCATED BELOW THE HORSESHOE BEND OF 40TH AVENUE WEST/HAINES ROAD ABOVE THE CANADIAN PACIFIC RAILWAY (SHERMAN AND ASSOCIATES).

The city of Duluth does ordain:

     Section 1. That Plate No. 17 of the zoning district maps as contained in the Appendix to Chapter 50 of the Duluth City Code 1959, as amended, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE: This ordinance will have no effect on the tax base. This zoning ordinance amendment provides a zoning change from S, Suburban, to R-1-a, One Family Residential, for property located below the horseshoe bend of 40th Avenue West/Haines Road above the Canadian National Pacific Railway right-of-way. The purpose of the rezoning is to facilitate the submittal of a special use permit for a townhouse development.


The Duluth city planning commission conducted a public hearing on this petition on November 9, 2004, and tabled action until December 14 to allow time for review and comment by Neighborhood District 2. Following additional public comment on December 14, 2004, and a failed motion (on a 5-6 vote) to deny the rezoning petition, the planning commission resolved (on a 10-1 vote) to forward this petition to the city council with no recommendation.
