RESOLUTION VACATING THE SOUTHERLY TWO FEET OF A 16 FOOT UTILITY AND PEDESTRIAN EASEMENT ON ST. ANDREWS STREET AT DUNEDIN AVENUE EAST OF HARTLEY FIELD IN WOODLAND (STEVEN AND CATHERINE LONG).

BY COUNCILOR GILBERT:

     WHEREAS, a sufficient petition was filed with the city clerk requesting the vacation of the southerly two feet of a 16 foot utility and pedestrian easement in St. Andrews Street between Dunedin Avenue to the east and Hartley Field to the West, between 2151 Dunedin Avenue and 2201 Dunedin Avenue, legally described as the southerly two feet of the 16 foot wide utility and pedestrian easement lying between Lot 1, Block 11, and Lot 14, Block 10, Glen Avon Third Division in St. Andrews Street, Exhibit A; and

     WHEREAS, pursuant to Section 100 of the City Charter and Article IV of Chapter 45 of the Duluth City Code, 1959,as amended, such petition was duly referred to the city planning commission and such commission gave due notice of public hearing and did consider same in public hearing; and

     WHEREAS, the city planning commission approved the southerly two foot vacation of the utility and pedestrian easement and petition at its December 14, 2004, meeting (reference Planning Commission File No. 04135).

     NOW, THEREFORE, BE IT RESOLVED, that the city council of the city of Duluth approves the vacation of the southerly two feet of a 16 foot utility and pedestrian easement in St. Andrews Street between Dunedin to the east and Hartley Field to the west between 2151 Dunedin Avenue and 2201 Dunedin Avenue (Public Document No. ___________).

     RESOLVED FURTHER, that the city clerk is hereby directed to record, with the register of deeds and/or the registrar of titles of St. Louis County, Minnesota, a certified copy of this resolution together with a plat showing the portion of the utility and pedestrian easement to be vacated.


STATEMENT OF PURPOSE:  This resolution will have no effect on the tax base. This resolution vacates the southerly two feet of a 16 foot utility and pedestrian easement in St. Andrews Street between Dunedin Avenue on the east and Hartley Field on the west, between 2151 Dunedin Avenue and 2201 Dunedin Avenue. This petition was unanimously approved by the Duluth planning commission at its regular meeting on December 14, 2004.
