AN ORDINANCE REPEALING ORDINANCE 8244, REPEALING DULUTH CITY CODE, CHAPTER 14A.


BY COUNCILOR STEWART:

The city of Duluth does ordain:

     Section 1. That Ordinance 8244, passed May 24, 1976, which established Chapter 14A of Duluth City Code, 1959, as amended, be repealed, and that said Chapter 14A of Duluth City Code, 1959, as amended, be repealed in its entirety.

     Section 2. That this ordinance take effect 30 days after its passage and publication.


STATEMENT OF PURPOSE:  This ordinance is not in conformance with modern retail practice. The following language in the City Code will be stricken:


CHAPTER 14A.

 

CONSUMER GOODS.

 

Article I. Retail sales of consumer goods at food stores;

marked prices required.

 

Sec. 14A-1. Definitions.

 

     For the purposed of this Article, the following words and phrases shall have the meanings respectively ascribed to them by this Section.

     Consumer good. Any personal property sold at a retail food store in the ordinary course of business other than single packs of cigarettes, single candy bars, and other individually packaged snacks, confections, or tobacco items when displayed at the checkout counter of such retail food store.

     Offer for sale. The displaying of a consumer good in a retail food store on a shelf or other display area where it can be purchased immediately by a buyer.

     Package. Any can, bottle, box, bag, wrapping, or other container or cover, used to either wholly or partially contain, cover or wrap any consumer good.

     Retail food store. Any store or any department of a store whose principal business is selling groceries to the general public at retail.

     Sell. Only those sales conducted within the store where delivery is made to the buyer at the time of sale or immediately thereafter.

 

Sec. 14A-2. Price marking required.

 

     No retail food store shall sell or offer for sale any packaged consumer good unless such good has its selling price legibly marked on its package. Said selling price shall be separately stated in Arabic numbers and shall not be a part of any Code. The provisions of this Section shall not apply to items offered at a sale price that is below the normal price at which the item is usually sold in that store if the item is offered at the sale price for a period of seven days or less.
