AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 43, AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM R-1-B, ONE-FAMILY RESIDENTIAL DISTRICT, TO C-1, COMMERCIAL DISTRICT, PROPERTY ON THE SOUTHEAST CORNER OF DODGE STREET AND 51ST AVENUE EAST (RICHARD KAY, COMMUNITY CONNECTION OF MINNESOTA, INC.).

BY COUNCILOR GILBERT:

The city of Duluth does ordain:

     Section 1. That Plate No. 43 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE:  This zoning ordinance amendment approved this zoning change from R-1-b, One Family Residential District, to C-1,Commercial District, four lots on the southeast corner of Dodge Street and 51st Avenue East.


The purpose of the rezoning is to retrofit and use the Lakeside Toolhouse for offices of the Community Connection of Minnesota, Inc.


The Duluth city planning commission unanimously approved this zoning change following a public hearing held on April 27, 2005. The commissioners based their recommendation on the following findings:

1.)  This rezoning will make all of the lots in this block of the same zoning.

2.)  The proposed new use of the tool house will be more compatible with adjacent residential areas.
