AN ORDINANCE AUTHORIZING CONVEYANCE OF PORTIONS OF LOT 10, BLOCK 117, AND LOT 10, BLOCK 118, WEST DULUTH SECOND DIVISION, TO THE DULUTH ECONOMIC DEVELOPMENT AUTHORITY (DEDA) FOR $7,256.

BY COUNCILOR GILBERT:

The city of Duluth does ordain:

     Section 1. That the city of Duluth hereby conveys to quit claim deed its right, title and interest in and to real estate located in St. Louis County, Minnesota, hereinafter described to DEDA for $7,256, said amount to be deposited in General Fund 100-700-1420-4640:

           Lot 10, Block 117,West Duluth Second Division, EXCEPT all that part lying northwest of the following described line: commencing at the northwest corner of Lot 10, Block 117; thence easterly along the north line of said Lot 10 a distance of 25 feet to Point of Beginning; thence deflecting to the right and continuing southwesterly in a straight line to the southwest corner of said Lot 10 and there terminating.

           Lot 10, Block 118, West Duluth Second Division, EXCEPT all that part lying northeast of the following described line: Commencing at the northeast corner of Lot 10, Block 118; thence westerly along the north line of said Lot 10 a distance of 25 feet to Point of Beginning; thence deflecting to the left and continuing southeasterly in a straight line to the southeast corner of said Lot 10 and there terminating.

     Section 2. That this ordinance shall take effect and be in force 30 days after its passage and publication.


STATEMENT OF PURPOSE: The purpose of this ordinance is to authorize the conveyance of two lots located in the Irving neighborhood to DEDA. DEDA, in turn, will convey the property along with additional property DEDA owns to CNN Properties, LLC (developer). The developer is constructing two buildings for assisted living, each consisting of not less than ten suites together together with related utilities, parking, landscaping and other amenities. Each building will cost not less than $599,000. The conveyance of the city property will assist in meeting setback requirements for the assisted living project. A 25 foot by 25 foot triance will be retained by the city for alleyway and snow plawing purposes.
