AN ORDINANCE AUTHORIZING CONVEYANCE OF CERTAIN PROPERTY IN CENTRAL HILLSIDE TO THE WOMEN’S TRANSITIONAL HOUSING COALITION, INC.

BY COUNCILOR STOVER:

The city of Duluth does ordain:

     Section 1. That the proper city officials are hereby authorized to convey by quit claim deed the below-described property in St. Louis County, Minnesota, to Women’s Transitional Housing Coalition, Inc., who will develop the property for low and moderate income housing, a public purpose, and to execute all documents necessary with regard to said conveyance:

           Lot 8, West Fifth Street, Duluth Proper First Division.

     Section 2. If, for any reason, Women’s Transitional Housing Coalition, Inc., fails to develop the above described property for the public purpose, aforesaid stated, not later than September 30, 2007, title to said property shall revert back to the city.

     Section 3. This ordinance shall take effect 30 days from and after its passage and publication.


STATEMENT OF PURPOSE: The purpose of this ordinance is to authorize the conveyance by quit claim deed of city-owned property in the Central Hillside neighborhood to the Women’s Transitional Housing Coalition, Inc., to allow them to develop low and moderate housing thereon.

The property is a 50 foot front by 140 foot deep lot, adjacent to a building already owned by Women’s Transitional Housing Coalition, Inc., at 10 West Fifth Street. The lot is excess to the city's needs. The city will convey the property to the coalition at no cost. The coalition will then construct on the property four units of affordable housing to be purchased by low and moderate income families, a public purpose. The coalition has secured Minnesota Housing Finance Agency funding to assist in the building of the homes.


If the coalition fails to construct the affordable housing units by September 30, 2007, the coalition will re-convey this property to the city.
