AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE, 1959, AS AMENDED, ZONING DISTRICT MAPS NO. 11, 13 AND 14, AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM S, SUBURBAN, TO R-1-A, SINGLE FAMILY RESIDENTIAL, PROPERTY LOCATED ABOVE WEST SKYLINE PARKWAY, SOUTH OF WEST ARBUTUS DRIVE AND APPROXIMATELY 1,600 FEET EAST OF US HIGHWAY 2 (SUGARLOAF).

BY COUNCILOR GILBERT:

The city of Duluth does ordain:

     Section 1. That Plates No. 11, 13 and 14 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication


STATEMENT OF PURPOSE: This ordinance should have no effect on the tax base.


This zoning ordinance amendment provides a zoning change, from S, Suburban, to R-1-a, One-Family Residential, 60 acres located above West Skyline Parkway, south of West Arbutus Drive and approximately 1,600 feet east of US Highway 2. This rezoning is to facilitate the subdivision of the property for residential purposes. The applicant states that “this rezoning will be in the public interest because it.”


The Duluth city planning commission approved this zoning change by a vote of 6-3-1 following public hearings held June 22 and August 8, 2005.


If over 15 acres; tax impact statement. No effect on the tax base there is no specific development proposal. The assessor indicates that when the property is platted and improved the new plat would have an increased value.
