BE IT RESOLVED, that the city council of the city of Duluth hereby approves the transfer of the following on sale intoxicating liquor license and on sale Sunday license for the period ending August 31, 2005, subject to departmental approvals and the payment of sales and property taxes:
Bergey’s LLC (Bergey’s), 2232 West Superior Street, with William Berg, president and 50 percent stockholder and Nancy Bennett, vice president and 50 percent stockholder, transferred from C&S of Duluth, Inc. (Terry’s Place), same address.
Alcohol, gambling and tobacco commission discussion of 7/6/2005: William Berg and Nancy Bennett were present on behalf of the application. To questioning from the commission, Mr. Berg replied that he has been bartending for over 30 years in Duluth and working at Terry’s for the past 16 years. Ms. Bennett stated that they do not plan any changes to the operation of the business. Officer Latour stated he has approved this application. To questioning from the commission, Ms. Lutterman, deputy city attorney, replied that if this application is approved the commission and city council, C&S of Duluth no longer would own the license for action to be taken against them. There being no further discussion, Mr. Karki moved that the application of BERGEY’S LLC (BERGEY’S) 2232 WEST SUPERIOR STREET, FOR THE TRANSFER OF THE ON SALE INTOXICATING LIQUOR AND SUNDAY LICENSE FOR THE PERIOD ENDING AUGUST 31, 2005, WITH WILLIAM BERG, PRESIDENT 50% OWNER, AND NANCY BENNETT, VP AND 50 % OWNER, TRANSFERRED FROM C&S OF DULUTH, INC. (TERRY’S PLACE), SAME ADDRESS, BE APPROVED AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Anderson seconded the motion and it was unanimously approved.
