BY COUNCILOR STOVER:
RESOLVED, that the proper city officers are hereby authorized to enter into development and assessment agreements, substantially in the form of those on file in the office of the city clerk as Public Document No. ______ and Public Document No. ______, with James Gruba and Therese Gruba and with Robert and Sandra Peters to reimburse city through assessment for the cost of upgrading water service to their properties at 311 East Anoka Street and 323 East Anoka Street, respectively, in the amount of $4,700 each, payable to the Special Assessment Debt Service Fund 325.
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize execution of agreements with James Gruba and Therese Gruba and with Robert and Sandra Peters to accept assessments against their properties located at 311 East Anoka Street and 323 East Anoka Street, respectively, which will reimburse the city for the cost of improving their present city water service by providing a connection from the city water tower located at Minneapolis and Mankato streets instead of from the Woodland reservoir which presently serves this property.
Presently, the properties have service directly from the Woodland reservoir. They would like to be able to receive service from the water tower which would significantly increase their water pressure, and the city, which has a SIP project underway in Anoka Street, is in a position to do the work at minimal cost to them. But, because their property is already served by city water, it would be difficult to justify an assessment for the new connection based on increased value to the property. Therefore, this agreement provides that they will agree to be assessed for the costs and will waive any defenses to the assessment.
