AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 43 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM S, SUBURBAN, TO R-1-B, SINGLE FAMILY RESIDENTIAL, PROPERTY LOCATED SOUTH OF GLENWOOD STREET ALONG THE NORTH SIDE OF NORTH RIDGE ROAD (CITY OF DULUTH).

BY COUNCILOR GILBERT:

     The city of Duluth does ordain:

     Section 1. That Plate No. 43 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE: This ordinance should have no effect on the tax base.


This zoning ordinance amendment provides a zoning change, from S, Suburban, to R-1-B, Single Family Residential, five lots located south of Glenwood Street along the north side of North Ridge Road in Northridge Estates. The purpose of this rezoning is to clear the title to the affected properties.


The Duluth city planning commission unanimously approved this zoning change following public hearings held October 26 and November 8, 2005.


In approving the zoning change the commission made the following findings of fact in support of the change:


     1.   The property is bounded on three and a half sides by R-1-b, Single Family Residential, zoning. This request will fill in a void in the R-1-b created by the adjoining zones and Glenwood Street.

     2.   This rezoning request is consistent with existing zoning and previous zoning actions of the city related to this neighborhood.
