RESOLUTION AUTHORIZING A CONTRACT FOR LEGAL SERVICES NOT TO EXCEED $10,000.

BY COUNCILOR LITTLE:

BE IT RESOLVED, that the proper city officials are authorized to execute and implement a contract, containing substantially the provisions of that one on file with the city clerk as Public Document No. __________, between the city and the law firm of Reyelts, Leighton, Bateman, Hylden and Sturdevant for services in the case of Roger J. Waller v. City of Duluth, Minnesota, State Farm Mutual Automobile Insurance Company; not to exceed $10,000; payment from Self Insurance Fund 605-036-1651-5304.

STATEMENT OF PURPOSE:  The city employee was involved in a car accident on March 12, 1999. Action was commenced against the city on March 9, 2005. The city attorney defends the city against these types of claims, but in this case a conflict of interest exists so that the city attorney’s office is not able to do so. Requests for proposals were published some time ago for this work.
