RESOLUTION AMENDING A SPECIAL USE PERMIT FOR A RADIO OR TELEVISION TOWER ELIMINATING THE EXPIRATION DATE AND ALLOWING THE PLACEMENT OF AN ADDITIONAL EQUIPMENT BUILDING ON PROPERTY LOCATED AT 1306 WINDSOR AVENUE IN THE TOWER FARM (FMHC/AAT COMMUNICATIONS).

BY COUNCILOR GILBERT:

     BE IT RESOLVED, that an alteration to the special use permit approved on April 17, 1972, for a 450 foot tall tower on the above described property is hereby granted to allow for the placement of an additional equipment building and the elimination of the expiration date for the permit, subject to the following condition:

           That the project be limited to, constructed and maintained in accordance with plans submitted by the applicant entitled “Nextel Partners, Inc., Central Entrance MN440P,” drafted by Edwards and Kelcey, Minneapolis, Minnesota, dated August 11, 2005.


STATEMENT OF PURPOSE:  This resolution alters a previously approved special use permit for a communications tower in the tower farm. Alterations include eliminating the expiration date previously set for the special use permit and allowing the placement of a 9'x16' equipment building adjacent to the tower. The applicant requested the additional equipment building to accommodate a cellular phone carrier that will be added to the existing tower.


The planning commission unanimously approved this resolution at its September 13, 2005, meeting. The approval was made because of the city planning commission's findings that appropriate safeguards will exist to protect the comprehensive plan and to conserve and to protect property values in the neighborhood if conditions are observed (Ref. File No. 05086).


The tax base impact of this resolution may result in a slight increase in the value of the tower due to the additional equipment installed.
