RESOLUTION AUTHORIZING AN AGREEMENT WITH THE ST. LOUIS AND LAKE COUNTIES REGIONAL RAILROAD AUTHORITY FOR USE OF ITS RIGHT-OF-WAY IN CONJUNCTION WITH THE EIGHT INCH WATERMAIN EXTENSION IN 90TH AVENUE EAST AND EAST SUPERIOR STREET (CITY JOB NO. 0484WA).

BY COUNCILOR STOVER:

     RESOLVED, that the proper city officials are authorized to enter into an agreement substantially in the form of that on file in the office of the city clerk as Public Document No. ____________ with the St. Louis and Lake Counties Regional Railroad authority for use of its right-of-way in conjunction with the city’s eight inch watermain extension in 90th Avenue East and East Superior Street, at a cost not to exceed $500, payable from Special Assessment Fund 0410, Agency 038, Object 5530, Project No. 0484WA.


STATEMENT OF PURPOSE:  This resolution authorizes an agreement with the regional railroad authority to use railroad right-of-way in conjunction with the city’s eight inch watermain in 90th Avenue East and East Superior Street extension.


Pursuant to the agreement authorized by this resolution, the city will make a one-time payment to the authority for use of the right-of-way. The city will also agree that such use will not interfere with the authority’s uses any more than necessary and that the authority will be protected from any liability arising out of the city’s usage.


The city has awarded a contract to construct an eight inch HDPE watermain extension to serve Tracts A through P of Registered Land Survey No. 62 on East Superior Street from 100 feet southwesterly of Cant Road to 1,926 feet northeasterly of 90th Avenue East. 100 percent of the property owners of Tracts A through P of Registered Land Survey No. 62 petitioned for a watermain extension. The property owners own 100 percent of the property to be assessed. The assessed property owners are paying for 100 percent of the cost of the improvements and waived their right to a public hearing. This watermain will be installed across the regional railroad tracks in a steel casing pipe. The steel casing pipe will be directionally drilled or jack-bored under the railroad tracks perpendicular to the railroad tracks in the 90th Avenue East right-of-way.
