BY COUNCILOR STOVER:
RESOLVED, that the proper city officers are hereby authorized to enter into a permit agreement, a copy of which is on file in the office of the city clerk as Public Document No. __________, authorizing the city to construct and maintain a storm sewer facility on university property at 60th Avenue East between London Road and Lake Superior (City Job No. 0431SN), subject to conditions as set forth therein at a cost of $450, payable from Fund 531, Agency 500, Object 5532.
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize execution of an agreement with the University of Minnesota which permits the city to construct, operate and maintain a storm sewer line on the university’s limnological building at 60th Avenue East adjacent to Lake Superior.
The city currently has a storm sewer line that runs down 60th into the lake but it is located on the easement upon which the city will be constructing the new sanitary sewage holding tank which will be constructed in that right-of-way. Therefore, the existing storm sewer must be moved.
The best location for the relocated pipe is immediately adjacent to the right-of-way on university property. The university is willing to allow the city to do so but in return is requiring the city to assume all liability arising out of its presence on the property as well as any liability arising out of its construction or maintenance. The document authorized by this resolution accomplishes this.
