RESOLUTION AUTHORIZING AGREEMENTS WITH BNSF RAILWAY COMPANY AND SOO LINE RAILWAY COMPANY RELATIVE TO THE CONSTRUCTION OF HELBERG DRIVE (ARTHUR AVENUE).

BY COUNCILOR STOVER:

     RESOLVED, that the proper city officials are hereby authorized to execute an agreement with BNSF Railway, a copy of which is on file in the office of the city clerk as Public Document No. __________, for the realignment of certain railway yard tracks, the construction of a new public at-grade crossing, and the removal of three existing public at-grade crossings in conjunction with the construction of Helberg Drive from Garfield Avenue to Port Terminal Drive, the cost of which shall be paid pursuant to a pre-existing agreement with the Duluth Seaway Port authority.

     FURTHER RESOLVED, that the proper city officials are hereby authorized to execute an agreement with Soo Line Railway (doing business as Canadian Pacific Railway), a copy of which is on file in the office of the City Clerk as Public Document No. __________, for the realignment of certain railway yard tracks and the construction of a new public at-grade crossing in conjunction with the construction of Helberg Drive from Garfield Avenue to Port Terminal Drive, the cost of which shall be paid pursuant to a pre-existing agreement with the Duluth Seaway Port authority.


STATEMENT OF PURPOSE:  This resolution authorizes the proper city officials to enter into two agreements with railway companies relative to the construction Helberg Drive from Garfield Avenue to Port Terminal Drive.


The respective agreements with BNSF and Soo Line (Canadian Pacific) relate to railway system and facility modifications that are required as part of the Helberg Drive construction project. The agreements will authorize the realignment of certain trackage at both railroads, the removal of certain existing track crossings and the installation of new track crossings, all to coincide with the anticipated needs of the new street, the port and the railroads.


Funding for the aspects of the project associated with railway modifications is a combination of federal highway transportation funds and Duluth Seaway Port authority funds. By prior agreement, the port authority agreed that the city will administer the construction project (as required by Mn/DOT and the federal highway administration) as part of State Project No. 118-200-01 (City Project No. 0103TR), and that the port authority would be responsible for all direct construction costs incurred in conjunction with the Helberg Drive project - including required railway modifications.
