BY COUNCILOR STOVER:
RESOLVED, that the proper city officials are authorized to execute a capacity allocation agreement, a copy of which is on file with the city clerk as Public Document No. __________, with the Western Lake Superior Sanitary District allocating to the city a share of the district’s wastewater treatment capacity for 2006 through 2010.
STATEMENT OF PURPOSE: The WLSSD provides treatment for sewage and wastewater created within the city. The city is required to implement a capacity agreement which defines the limits of waste generated in Duluth that can be delivered to WLSSD’s facilities. This is a renewal of the agreement that started in 2000 and runs through December 31, 2005.
The capacity allocation for flow has decreased from 20.5 MGD to 16.0 MGD. There is no charge unless these capacities are exceeded.
A surcharge fee for exceeding the allocated capacity is assessed only when the treatment plant incurs additional cost for treating the excess loading. To date, the city has not been billed any surcharge fees.
