RESOLUTION APPROVING THE TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE AND APPLICATION FOR AN ON SALE SUNDAY LICENSE AND 2:00 A.M. BEVERAGE LICENSE FROM PK & JS, INC. (TWINS BAR), 501 EAST FOURTH STREET, TO J&J MILLER, INC. (COPASETIC LOUNGE), 322 EAST CENTRAL ENTRANCE.

     BE IT RESOLVED, that the Duluth City Council hereby approves the transfer of the following on sale intoxicating liquor license and application for an on sale Sunday license and a 2:00 a.m. beverage license for the period ending August 31, 2006, subject to departmental approvals, and the payment of sales and property taxes:

           J&J Miller, Inc. (Copasetic Lounge), 322 East Central Entrance, with Joel Miller, 50 percent stockholder, and Gerald Miller, 50 percent stockholder, transferred from PK & JS, Inc. (Twins Bar), 501 East Fourth Street.


Alcohol, gambling and tobacco commission meeting discussion of 11/2/2005: Gerald Miller and Joel Miller were present on behalf of the application. Gerald Miller explained that they have been working for several months in obtaining this location to have a sports bar with a liquor license. The clerk reviewed that they are acquiring an inactive liquor license and are applying for a Sunday license. Attorney Lutterman reviewed the requirements of the code for a Sunday license which requires the principal part of the business the serving of the food and seating for 50. To questioning from the board, Mr. Joe Miller replied that they are not putting in a full kitchen, but they will be having a limited menu that will be serving frozen foods which would qualify them for a Sunday license and will have seating for approximately 75. Commissioner Serre expressed concern that the commission has been holding applicants to different standards for a Sunday license. Officer Latour reviewed that a Sunday license for a hotel has different requirements than a restaurant Sunday license. To further questioning, Mr. Gerald Miller replied that they have limited experience in the serving of alcoholic beverages and that they hope to be open in about two to three months. To further questioning, Mr. Gerald Miller replied that they will be remodeling the building and landscaping outside. There being no further discussion, Mr. Karki moved that THE APPLICATION OF J&J MILLER, INC. (COPASETIC LOUNGE), 322 EAST CENTRAL ENTRANCE, FOR TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE FROM PK & JS, INC. (TWINS BAR), 501 EAST FOURTH STREET, AND APPLICATION FOR AN ON SALE SUNDAY LICENSE AND 2:00 A.M. BEVERAGE LICENSE FOR THE PERIOD ENDING AUGUST 31, 2006, WITH GERALD MILLER, 50 PERCENT STOCKHOLDER, AND JOEL MILLER, 50 PERCENT STOCKHOLDER, BE APPROVED AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Hanson seconded the motion and it was unanimously approved.
