The city of Duluth does ordain:
Section 1. That development within the boundaries of TND No. 2 shall be governed by and regulated in accordance with Public Document No. ________ entitled, “Harbor View /Central Hillside Revitalization, Traditional Neighborhood Development Code,” dated November 15, 2002, amended December 20, 2002, amended March 24, 2004, amended September 28, 2005, amended October 14, 2005, amended January 25, 2006 (Planning Commission File No. 05106).
Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.
STATEMENT OF PURPOSE: This zoning ordinance amendment provides for amendments to the “Harbor View /Central Hillside Revitalization, Traditional Neighborhood Development Code,” documents of implementation.
The documents amount to a thorough re-analysis of the physical conditions of the project area as well as updated changes relating to the needs and desires of the project residents.
The documents offered amount to a replacement of the existing amended ordinances listed above.
The new document amounts to a thorough re-analysis of the physical conditions of the project area as well as updated changes relating to the needs and desires of the project residents. The “Regulating Plan (pg 2)”, The “General Lot Configuration (pg 3)” and the “General Utility Plan (pg 19)” have been changed to deal with and better relate to the topography and view shed of the property.
The document provides for a mixed use condominium building “Flexspace for Future Retail” on the general lot plan; a smaller and relocated “Community Center”; a larger and centrally located “Village Green” as well as a “Neighborhood Park.” The “Senior Facility” is removed as this specific need is seen more appropriately accommodated as the “Mixed -Use Condominium Building (pg 7).”
On Page 4: For Street Type S16 (alleys), Parallel Parking street section is added. For Street Type 28, Park, on street parking moved to the other side of the street.
Previous regulations omitted provisions for “Signage” which is now addressed (pg 5).
On Page 6: the “Height and Grading” roof diagram has changed; Parking #3 reads, “All parking shall be provided in the shaded area above, EXCEPT”; Accessible parking spaces for ground floor units may be provided as on street parking in ROW. “Elements”#3 added- “Porch location identified in this document does not represent the actual length of porch. Porch will not be continuous.”
On pages 6,7,8,10,11 and 13: “Parking” note added - “Parallel parking allowed; 5' apron not required for parallel parking.”
On Page 7: “Height and Grading” roof diagram changed; “Parking” #2 reads, “Parking shall be provided within the structure; a limited number of spaces may be surface parking in the rear of the building.” “Elements” porch diagram added. “Elements” #5 added- “Open porches shall not be placed outside the shaded area shown.” “Element” #6 added- “Porch location identified in this document does not represent the actual length of porch. Porch will not be continuous.”
Pages 9, 12 and 14: Private drive dimension changes from 10' max. to 12' max.
The balance of the documents restate the provisions, intent and regulation of the TND as originally proposed and approved in 2002.
The Duluth city planning commission conducted a public hearing on October 26, 2005, and has unanimously recommended approval of these changes, however, the documents needed street name changes which were not provided to the city until January 23, 2006.
There is no tax impact.
