RESOLUTION AUTHORIZING THE CONVEYANCE OF CITY PROPERTY TO DEDA WITHOUT BIDS AT NO COST.

BY COUNCILOR GILBERT:

     RESOLVED, that the proper city officials are hereby authorized to convey by quit claim deed the property described below to the Duluth economic development authority (DEDA) without bids at no cost:

           Lots 1 through 4-1/2, Block 186, West Duluth Seventh Division.


STATEMENT OF PURPOSE:  This resolution provides for the conveyance of certain property to DEDA without bids at no cost as required pursuant to Section 2-177 of the Duluth City Code.


The city inadvertently received the land through a land swap with Menards in 2003. The land swap was intended to be between DEDA and Menards to facilitate the new Menards building in West Duluth and to provide property for housing development by SVCNDA as indicated in the Ramsey Village revitalization plan. The quit claim deed was mistakenly issued by Menards to the city of Duluth instead of DEDA and was filed in the St. Louis County recorder’s office. This resolution will allow the property to be conveyed to DEDA as was intended by parties without going through the bidding process and without cost.
