RESOLUTION AUTHORIZING AGREEMENT WITH WHITE PINES DEVELOPMENT, INC., FOR THE CONSTRUCTION OF ROADS AND UTILITIES IN THE DEVELOPMENT AND ASSESSMENT OF THE COSTS THEREOF.

BY COUNCILOR STOVER:

     RESOLVED, that the proper city officers are hereby authorized to enter into an agreement, a copy of which is on file in the office of the city clerk as Public Document No. __________, with the White Pines Development, Inc., for the construction of utilities for the Cedar Ridge Estates development and the assessment of the cost thereof to the developer, and for the payment of connections fees arising out of connection to said utilities to the developer.


STATEMENT OF PURPOSE:  The purpose of this resolution is to authorize an agreement with White Pines Development Inc., the developer of the Cedar Ridge Estates housing development located west of Howard Gnesen Road and along and above South Road which will create 24 new single family lots.


Pursuant to the agreement, the city is to construct a street, sidewalks, water, gas and sewer mains, a storm water system and decorative lighting to serve the project, all as shown on the approved plat; the total cost of these improvements is approximately $1.3 million. The developer will reimburse the city for the costs of constructing those improvements, either through a down payment of $185,331.65, which has already been paid, or through the assessment process.


In addition, the developer will dedicate all street right-of-way and all utility easements necessary to the development at no cost to the city. As part of meeting the requirements imposed on the city by the NPDES process, the developer will be constructing and will be committing to maintaining storm water retention facilities on the site. This will be a perpetual obligation which will “run with the land”.


As the developer is paying for the utilities being constructed, the city is agreeing, in line with its standard practices, to pay a portion of the connection fees it receives to the developer.
