AN ORDINANCE AMENDING ORDINANCE NO. 9001 TO PROVIDE FOR A NEW PUBLIC DOCUMENT (DULUTH LODGE, LLC).

BY COUNCILOR GILBERT:

The city of Duluth does ordain:

     Section 1. That the provisions of Ordinance No. 9001, passed October 9, 1990, be amended as follows;

     (a)  That Section 6, subd 2, be amended to replace Public Document No. 90-1009-24 with the architectural site plan submitted and dated 5/19/06 and on record as Public Document No. _________________.

     Section 2. That all other terms of Ordinance No. 9001 remain in force and effect.

     Section 3. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE:   On October 9, 1990, Ordinance No. 9001 was approved and granted a concurrent use permit to “Park Inn” to “occupy, construct and maintain parking and driveways in portions of South First Avenue East” (now Canal Park Drive) in accordance with Public Document No. 90-1009-24, and imposing certain conditions, limitation and restriction in relation to such concurrent use permit. These changes are in association with the redevelopment of the property as the “Duluth Lodge.”


This ordinance provides for an amendment to Ordinance No. 9001 to accept a new site plan (public document) for the changes to the parking and landscaping located within the same portion of South First Avenue East (now Canal Park Drive); and that all other terms of Ordinance No. 9001 remain in force and effect.


A resolution accepting the easement for roadway purposes, over a portion of the private property located at the intersection of Canal Park Drive and Railroad Street, will be coming to the council for action with the second reading of this ordinance.


The planning commission heard this request at its meeting on June 13, 2006, and after consideration of the amendments contained in this ordinance, unanimously recommended approval (FN 06059).


In their deliberations, the commission considered the following issues:

     (a)  The amendments requested result in improvements to the traffic flow at the intersection of Canal Park Drive/Lake Avenue Overpass and Railroad Street;

     (b)  In association with this redevelopment all or portions of 25 hotel parking spaces are located within the Canal Park Drive (South First Avenue East) right-of-way. This is an increase from 19 spaces in the current configuration.
