The city of Duluth does ordain:
Section 1. That Plate No. 35 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.
STATEMENT OF PURPOSE: This zoning ordinance amendment provides a zoning change, from R-3, Apartment Residential, to C-1, Commercial District, for two lots legally described as Lots 7 and 8, Block 18, Banning & Ray’s Subdivision, Duluth. These lots are currently occupied by the Lake Superior Dental Clinic. The address is 1225 East First Street. Applicant states the purpose of this request is “to make this property available for continued commercial use consistent with the area. We believe that this rezoning will be in the public interest because it updates the property classification to reflect usage for the past 25 years.”
The Duluth city planning commission voted to APPROVE this zoning change following a public hearing held July 11, 2006, by a 9 to 0 vote.
In recommending approval of the zoning change the planning commission made the following findings of fact:
1. Property has been used for commercial activity since November 1978.
2. Action corrects a mapping error.
3. The clinic appears compatible with surrounding land uses.
4. Conforms to the recently adopted comprehensive plan.
This ordinance should have no effect on the tax base as the property is already developed and no changes are being proposed.
