RESOLVED, that the proper city officials are authorized to execute and implement a contract between the city of Duluth and Anderson Golf, Inc., substantially the same as that on file with the clerk as Public Document No. ___________, for services as a golf professional in operating Enger Park Golf Course, for compensation of $45,000, possible additional compensation of $3,000, possible performance incentive payments of $45,000, and reimbursement of operating expenses; payment to be made from Fund 503, Agency 400, Organization ENGR.
STATEMENT OF PURPOSE: This resolution authorizes a contract with a golf pro. The golf pro will operate the Enger Park Golf Course, food concession, golf club and golf cart rental, driving range, pro shop, and related activities. The city will pay $45,000 in salary, an additional salary in the amount of $3,000 which is contingent upon the pro obtaining an intoxicating liquor license and operating intoxicating liquor concessions during the golf season, and a percent of sales not to exceed $45,000. The city will buy inventory and pay for operating expenses, including cost of pro’s employees. The contract replaces and supercedes the contract approved in 2005 by clarifying the pro’s status as an independent contractor and more specifically providing the pro with management and control of the operations defined in the contract. The contract also provides for the operation of intoxicating liquor concessions the authority for which was approved by the state legislature in 2005.
