BY COUNCILOR KRAUSE:
BE IT RESOLVED, that the city council of the city of Duluth hereby approves the transfer of the following on sale intoxicating liquor license, on sale Sunday license and application for a 2:00 a.m. beverage license for the period ending August 31, 2006, subject to departmental approvals, the payment of sales and property taxes, and approval of the liquor control commissioner:
Hospitality Associates of Duluth, LLC (Aces on First), 113 West First Street, with Nick Patronis, president and 33-1/3 percent stockholder, Mark Carlson, secretary/treasurer and 33-1/3 percent stockholder, and Bryan Flaherty, 33-1/3 percent stockholder.
Alcohol gambling and tobacco commission discussion of 5/3/2006: Nick Patronis was present on behalf of the application. Mr. Patronis stated he and associates are looking to transfer this license and hope to reopen the establishment around June 20 when they are done remodeling the bar. To questioning from the commission, Mr. Patronis stated Gary Wizner is not part of the ownership or management of the bar, but during the winter months he may be working in the bar. To further questioning, the clerk reviewed that all fines have been paid that were imposed by the council and all taxes have been paid. The clerk also reviewed that the commission’s recommendation at Wizner’s hearing last month was a 60 day suspension, but it would be stayed for 30 days from council approval to allow a potential transfer of this liquor license. There being no further discussion, Mr. Anderson moved that THE APPLICATION OF HOSPITALITY ASSOCIATES OF DULUTH , LLC (ACES ON FIRST), 113 WEST SUPERIOR STREET, FOR TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE, ON SALE SUNDAY LICENSE AND APPLICATION FOR A 2:00 A.M. BEVERAGE LICENSE FOR THE PERIOD ENDING AUGUST 31, 2006, WITH NICK PATRONIS, PRESIDENT AND 33-1/3 PERCENT STOCKHOLDER, MARK CARLSON, SECRETARY/TREASURER AND 33-1/3 PERCENT STOCKHOLDER, AND BRYAN FLAHERTY, 33-1/3 PERCENT STOCKHOLDER, TRANSFERRED FROM WIZNER COMPANY (NORMAN’S BAR), SAME ADDRESS BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Serre seconded the motion and it was unanimously approved.
