RESOLUTION REQUESTING THE FREE CONVEYANCE OF A UTILITY EASEMENT ACROSS TAX FORFEITED LAND FOR PURPOSES OF CONSTRUCTION OF A SIX INCH PE HIGH PRESSURE GAS MAIN ON THE SOUTH SIDE OF EAST SUPERIOR STREET BETWEEN 63RD AVENUE EAST AND 65TH AVENUE EAST.

BY COUNCILOR STOVER:

     RESOLVED, that the Saint Louis County Board of Commissioners is hereby requested to free convey to the city of Duluth a utility easement across the following tax forfeited parcel for purposes of construction of a six inch PE high pressure gas main located on the south side of East Superior Street between 63rd Avenue East and 65th Avenue East (Job No. 0030GS):

15 foot wide strip of Lot 4 on the south side of East Superior Street between 63rd Avenue East and 65th Avenue East


STATEMENT OF PURPOSE:  This resolution requests that the Saint Louis County Board of Commissioners free-convey a utility easement across the described tax forfeited land for purposes of construction of a six inch PE high pressure gas main located on the south side of East Superior Street between 63rd Avenue East and 65th Avenue East. This 15 foot wide utility easement is needed for the proposed gas main construction because superior Street was constructed so close to the south right-of-way line that there is not enough right of way outside of the street surfacing to construct the gas main. The lots to the east of Lot 4 are owned by the state of Minnesota and are retained in conservation.
