BY COUNCILOR STAUBER:
RESOLVED, that the proper city officials are authorized to enter into a limited use permit for non-motorized recreational trail, a copy of which is on file with the city clerk as Public Document No. ___________, from the state of Minnesota department of transportation (Mn/DOT)to allow the extension of the Superior Hiking Trail over or upon Mn/DOT right-of-way at various locations.
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the acceptance of a limited use permit from Mn/DOT authorizing the use of portions of the department’s right-of-way for the connection of the Superior Hiking Trail.
The areas affected are shown on the maps attached to the resolution. They include crossings of Interstate Highway 35 near Cody Street and 11th Avenue West and of Piedmont Avenue near Upper Lincoln Park (including a parking area) and below the “Five Corners” area. As part of the permit, the city is required to accept all responsibility for construction and maintenance and required to indemnify the state for any liability occurring.
The city, by companion resolution amending our existing agreement, will add these areas to the areas covered by the existing agreement between the city and Superior hiking trail association which will then allow there to be continuity of the trail through the city.
Although the association will be the ultimate user of the licence, Mn/DOT has required that it be granted to the city who may then pass it along to the association.
