AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 38 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM M-1, MANUFACTURING DISTRICT, TO C-1, COMMERCIAL DISTRICT, PROPERTY LOCATED AT 1901 SOUTH STREET (JOSEPH AND ROSE KLEIMAN).

BY COUNCILOR GILBERT:

The city of Duluth does ordain:

     Section 1. That Plate No. 38 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE:  This zoning ordinance amendment provides a zoning change, from M-1, Manufacturing, to C-1, Commercial District, for three lots legally described as Lots 14 and the southerly 58 feet of Lots 15 & 16, Endion Division, Duluth. These lots are located at 1901 South Street and are occupied by a recently constructed office building and parking lot.


Applicant states “the purpose of this rezoning is to make this property available for residential use as a mixed use facility in addition to the existing two levels of office space in the newly constructed building. We believe that this rezoning will be in the public interest because this property is currently surrounded by residential properties and additional residential units would fit the integrity of the neighborhood rather than the current zoning (M-1) which allows for construction of industrial type buildings and applications. Parking demands for residential use are not as intense compared to a commercial application.”


The Duluth city planning commission voted to APPROVE this zoning change following a public hearing held September 12, 2006, by a 6-0-1 vote.


In recommending approval of the zoning change the planning commission made the following findings of fact:

     1.   Conforms to the recently adopted comprehensive plan;

     2.   Property is zoned M-1, changing zoning to C-1 reduces potential conflicts with adjacent properties;

     3.   Proposed zoning is C-1 which is compatible to zoning along London Road, which is C-2.


This ordinance should have no effect on the tax base as the property is already developed and no changes are being proposed.
