Bay View Addition Number 2 Duluth, Block 57, Lots 12 to 24 (Plat 0230, Parcel 05240) and the southerly 340 feet of land described as proprietor reservation reserved for railroad right-of-way (part of Plat 2030, Parcel 05240)

south of Irwin Avenue in Bayview Heights

STATEMENT OF PURPOSE:  This resolution requests that the Saint Louis County Board of Commissioners free-convey the described tax forfeited land for street and utility purposes.

This request is to provide secondary access to Sugarloaf Skyline Estates. Current access to this subdivision is off Skyline Parkway. A second access is required for full build out of the 73 lots within the proposed subdivision.

This preliminary subdivision request for Sugarloaf Skyline Estates was reviewed by the city planning commission at its regular meeting of Wednesday, April 26, 2006. The planning commissioners voted 8-0-2 to approve the preliminary subdivision with the following conditions:

     1.  A second access right of way is to be secured prior to submission of the final plat.

     2.  Language included in the plat or documents that permits pedestrian use of the outlots for trails.

This free conveyance of tax-forfeited land to the city is a public-to-public transfer; therefore, there is no tax base impact at this time. In addition, the land will not be available to join the tax base in the future.
