RESOLUTION APPROVING THE ISSUANCE OF AN ON SALE WINE LICENSE AND ISSUING AN ON SALE 3.2 PERCENT MALT LIQUOR LICENSE TO TORKE, INC. (TORKE), 37 EAST SUPERIOR STREET.

BY COUNCILOR KRAUSE:

     BE IT RESOLVED, that the city council of the city of Duluth hereby approves issuance of the following on sale wine license by the liquor control commissioner and issues the following on sale 3.2 percent malt liquor license for the period ending August 31, 2007, and April 30, 2007, respectively, subject to departmental approvals and the payment of sales and property taxes:

           Torke, Inc. (Torke), 37 East Superior Street, with Wayne Torke, president and John Elliott, secretary.


Alcohol, gambling and tobacco commission discussion of 8/2/2006: Wayne Torke was present on behalf of the application. Mr. Torke reviewed that they used to have an on sale intoxicating liquor license, but let it lapse, and have decided to apply for a wine and beer license in order to sell champagne that they were known for. He continued saying that they are open for lunches and hope to be open in September for German dinners two nights a week. The commission questioned if the applicant meets the definition of a restaurant for the wine license. Mr. Torke replied that they have a full kitchen and food license from the health department, and that they can serve food at any time of the day when they are open. Officer Latour stated that they meet the seating requirement for the wine license, and he has approved their application. There being no further discussion, Mr. Hanson moved that THE APPLICATION OF TORKE, INC. (TORKE), 37 EAST SUPERIOR STREET, FOR AN ON SALE WINE LICENSE, ON SALE SUNDAY LICENSE, AND ON SALE 3.2 PERCENT MALT LIQUOR LICENSE FOR THE PERIOD ENDING BEGINNING SEPTEMBER 1, 2006, AND ENDING AUGUST 31, 2007, AND APRIL 30, 2007, RESPECTIVELY, WITH WAYNE TORKE, PRESIDENT AND JOHN ELLIOTT, SECRETARY, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Serre seconded the motion and it was unanimously approved.
