RESOLUTION DENYING THE RENEWAL OF THE ON SALE INTOXICATING LIQUOR LICENSE, ON SALE SUNDAY LICENSE AND 2:00 A.M. BEVERAGE LICENSE OF DARREL FREDRICKSON (HORSESHOE BILLIARDS), 2415 WEST SUPERIOR STREET.

BY COUNCILOR KRAUSE:

     BE IT RESOLVED, that the city council of the city of Duluth hereby denies the renewal of the following on sale intoxicating liquor license, on sale Sunday license and 2:00 a.m. beverage license for the period beginning September 1, 2006, and ending August 31, 2007, pursuant to Section 8-64 of the Duluth City Code, prohibiting the issuance of an intoxicating liquor license to any person who shall be convicted of any violation of any law of the United States, state law or local ordinance:

           Darrel Fredrickson (Horseshoe Billiards), 2415 West Superior Street.


Alcohol, gambling and tobacco commission discussion 8/2/2006: Assistant City Attorney Lutterman reviewed that Darrel Fredrickson has been charged in federal court with conspiracy to distribute controlled substances, and that he has pled guilty but has not yet been sentenced. She continued saying that although technically under the law one is not convicted until one is sentenced, in this situation when someone enters a plea agreement and pleads guilty, they usually are sentenced and convicted. Ms. Lutterman stated that according to City Code, an individual who has been convicted of a felony such as this isn’t eligible for an intoxicating liquor license, and the chief of police is not going to recommend approval of this license. Ms. Lutterman stated that it is the city’s request that this commission recommend to the city council that this particular license not be renewed. There being no further discussion, Mr. Anderson moved THAT THE RENEWAL APPLICATION OF DARREL FREDRICKSON (HORSESHOE BILLIARDS), 2415 WEST SUPERIOR STREET, FOR AN ON SALE INTOXICATING LIQUOR LICENSE, ON SALE SUNDAY LICENSE AND 2:00 A.M. BEVERAGE LICENSE FOR THE PERIOD BEGINNING SEPTEMBER 1, 2006, AND ENDING AUGUST 31, 2007, BE DENIED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Hanson seconded the motion and it was unanimously approved.
