BY COUNCILOR GILBERT:
The city council finds that a sufficient petition was filed with the city clerk requesting the vacation of the southeasterly eight feet of 29th street, legally described as that portion of 29th street lying within eight feet of Lot 201, Lower Duluth, Lake Avenue, and within eight feet of Lot 202, Lower Duluth, Minnesota Avenue; and, pursuant to Section 100 of the City Charter and Article IV of Chapter 45 of the Duluth City Code, 1959, as amended, such petition was duly referred to the city planning commission and such commission gave due notice of public hearing and did consider same in public hearing; and the city planning commission unanimously approved the street vacation at its September 12, 2006, meeting; and the city planning commission found that said street is useless for the purpose for which it was intended, based on the finding that; there is no need for this right-of-way as a street.
NOW, BE IT RESOLVED, that the city council of the city of Duluth approve the partial vacation of 29th Street described above, as more particularly described on Public Document No. ___________.
RESOLVED FURTHER, that the city clerk is hereby directed to record, with the register of deeds and/or the registrar of titles of St. Louis County, Minnesota, a certified copy of this resolution together with a plat showing the portion of the street to be vacated.
STATEMENT OF PURPOSE: This resolution vacates the southeasterly eight feet of unimproved 29th Street, between Lake Avenue South and Minnesota Avenue, on Park Point. Street right-of-way easement for vehicular and pedestrian traffic and parking retained. This petition received a unanimous approval of the Duluth planning commission at its regular meeting on September 12, 2006.
This resolution should have no effect on the tax base because there is no development proposed for the vacated portion.
