RESOLUTION AUTHORIZING AN AMENDED AGREEMENT WITH U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR HUMAN RIGHTS ENFORCEMENT.

BY COUNCILOR NESS:

     RESOLVED, that the proper city officials are authorized to execute and implement an amended agreement, substantially the same as that on file with the city clerk as Public Document No. __________ between the city and the U.S. department of housing and urban development providing for enforcement of federal civil rights laws and processing of related complaints by the city human rights office and other related matters, which is a revision of the agreement authorized by Resolution 06-0399, passed by the city council on May 22, 2006, to include a new paragraph no. 6 of Section V(B) entitled Reactivation.


STATEMENT OF PURPOSE:  This revision to the previously approved interim agreement between the city and the U.S. department of HUD would provide a mechanism for HUD to reactivate a complaint which has been determined to have achieved probable cause and which, for any reason, the city attorney has not or does not proceed to court within sixty days of probable cause determination. Such reactivation by HUD would allow HUD to proceed with judicial action on behalf of the complainant.
