That part of the Southwest Quarter of Southwest Quarter of Section 13, Township 49 North, Range 15 West of the Fourth Principal Meridian, St. Louis County, Minnesota, lying southeasterly of a line described as follows:

Commencing a the intersection of the south line of said Southwest Quarter of the Southwest Quarter with the southeasterly right-of-way line of the Burlington Northern, Inc. (formerly the Duluth Transfer Track of the Pacific Railway) as located; thence on an assumed bearing of north 89 degrees 38 minutes 10 seconds east, along said south line, a distance of 115.91 feet to the point of beginning of the line to be described; thence north 32 degrees 43 minutes 19 seconds east, a distance of 389.84 feet; thence north 43 degrees 56 minutes 11 seconds east, a distance of 347.41 feet to the south line of Pulaski Street as located and there terminating.

STATEMENT OF PURPOSE:  This free conveyance of 1.46 acres of tax-forfeited land to the city is a public-to-public transfer; therefore, there is no tax base impact at this time. In addition, the land will not be available to join the tax base in the future.

This resolution requests that the Saint Louis County Board of Commissioners free-convey the described tax forfeited land for street and utility purposes. This parcel was owned by the developer of adjacent land. This developer had intended to dedicate to the city a roadway across this property (Bayhill Drive) but neglected to pay the taxes on the land and so it went tax forfeited before the dedication could be completed. Bayhill Drive is already constructed on this property and so this free-conveyance will transfer ownership of this street to the city.

This request was reviewed by the city planning commission at its regular meeting of Wednesday, September 27, 2006. The commissioners voted unanimously to recommend that the city council request the free conveyance of this property to the city of Duluth.
