RESOLUTION ACCEPTING AND DEDICATING AN EASEMENT FOR STREET AND UTILITY PURPOSES AT NO COST FROM ROBERT ALLEN BAUERS ADJACENT TO ROBIN AVENUE IN DULUTH HEIGHTS.

BY COUNCILOR STOVER:

     RESOLVED, that the proper city officers are hereby authorized to accept the dedication on behalf of the general public, an easement for street and utility purposes, from Robert Allen Bauers over the following described property in St. Louis County, Minnesota, and to execute all documents necessary thereto:

           Lot 30, Block 6, DULUTH HEIGHTS FIFTH DIVISION; said easement being more particularly described as follows to-wit:

                 Westerly 17 feet of Lot 30, Block 6, DULUTH HEIGHTS FIFTH DIVISION.

     RESOLVED, that the city of Duluth hereby expresses its appreciation and gratitude to Robert Allen Bauers for said easement.


STATEMENT OF PURPOSE: The westerly 33 feet of Lot 30 was previously tax forfeit. In conjunction with the St. Louis County land department, Lot 30 was recently sold to Mr. Bauers, the adjoining property owner. As a condition of that sale, the county land department reduced the per square foot selling price of the westerly 17 feet of Lot 30 in exchange for Mr. Bauers agreeing to grant the city an easement for street and utility purposes over the westerly 17 feet of Lot 30. This resolution accepts and dedicates this easement from Mr. Bauers to the general public and expresses the city’s appreciation to him.


Tax base impact summary: Although Lot 30 will be returned to the tax roles, the tax impact of the easement area is deminimus.
