RESOLUTION APPROVING THE TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE, ON SALE SUNDAY LICENSE AND 2:00 A.M. BEVERAGE LICENSE AND APPLICATION FOR AN ON SALE DANCING LICENSE FROM BLACK RIVER MILLS, INC. (NORSHOR THEATRE), 211 EAST SUPERIOR STREET, TO NORSHOR EXPERIENCE, INC. (NORSHOR EXPERIENCE), SAME ADDRESS.

BY COUNCILOR KRAUSE:

     BE IT RESOLVED, that the city council of the city of Duluth hereby approves the transfer of the following on sale intoxicating liquor license, on sale Sunday license, and 2:00 a.m. beverage license and the application for an on sale dancing license for the period ending August 31, 2007, subject to departmental approvals, the payment of sales and property taxes and further subject to documentation of each employee hired by of Norshor Experience, Inc.:

           Norshor Experience, Inc. (Norshor Experience), 211 East Superior Street, with James Gradishar, 100 percent stockholder, transferred from Black River Mills, Inc. (Norshor Theatre), same address.


Alcohol, gambling and tobacco commission discussion of 12/6/2006: James Gradishar was present on behalf of the application. Mr. Gradishar reviewed that currently Black River Mills operates the liquor license and Norshor Experience runs the entertainment at the Norshor Theatre. He explained that Dr. Ringsred is too busy to run the liquor side of the business, so he would like to take over the operation of the liquor sales along with the entertainment and has entered into an agreement with Dr. Ringsred to transfer the license. To questioning from Assistant City Attorney Lutterman, Mr. Gradishar replied that no money is being exchanged in this transfer, and the license will go back to Dr. Ringsred if he is unable to make a profit in the business. He continued saying that he and Dr. Ringsred will be drawing up an agreement for the transfer of the license, and that the clerk has requested a copy of that agreement. Ms. Lutterman reviewed that there was a problem at the Norshor when Mr. Gradishar’s employees were selling the liquor instead of Black River Mill’s employees, and suggested that the commission request a copy of the documentation showing who is employed by Norshor Experience. To questioning from the commission, Mr. Gradishar replied he would like to have the transfer complete by January 1. There being no further discussion, Mr. Hendrickson moved that THE APPLICATION OF NORSHOR EXPERIENCE, INC. (NORSHOR EXPERIENCE), 211 EAST SUPERIOR STREET, FOR TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE, SUNDAY LICENSE, 2:00 A.M. BEVERAGE LICENSE AND APPLICATION FOR AN ON SALE DANCING LICENSE FOR THE PERIOD ENDING AUGUST 31, 2006, WITH JAMES GRADISHAR, 100% STOCKHOLDER, TRANSFERRED FROM BLACK RIVER MILLS, INC. (NORSHOR THEATRE), SAME ADDRESS, BE APPROVED SUBJECT TO DOCUMENTATION OF EACH EMPLOYEE HIRED BY OF NORSHOR EXPERIENCE, INC., AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Hanson seconded the motion and it was unanimously approved.
