RESOLUTION APPROVING THE TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE AND SUNDAY LICENSE AND APPLICATION FOR A 2:00 A.M. BEVERAGE LICENSE FROM MIDWAY BAR, INC. (MIDWAY BAR), 1909 WEST SUPERIOR STREET, TO SHAND, LLC (BLUE CRAB BAR), SAME ADDRESS.

BY COUNCILOR KRAUSE:

     BE IT RESOLVED, that the city council of the city of Duluth hereby approves the transfer of the following on sale intoxicating liquor license and on sale Sunday license and approves the application of a 2:00 a.m. beverage license for the period ending August 31, 2007, subject to departmental approvals and the payment of sales and property taxes:

           Shand, LLC (Blue Crab Bar), 1909 West Superior Street, with Brian D. Shand, president and 60 percent stockholder, and Jeffrey Shand, vice president and 40 percent stockholder, transferred from Midway Bar, Inc. (Midway Bar), same address.


Alcohol, gambling and tobacco commission discussion of 1/3/2007:    Brian Shand was present on behalf of the application. Mr. Shand explained that he has a small amount of experience in the restaurant business and this is first experience with selling alcohol. To questioning from the commission, Mr. Shand he is aware of the rules and regulations for selling alcohol, and that he has been taking an on line course on alcohol responsibility. To further questioning, Officer Latour stated he has approved this application. Mr. Shand explained that other than the name change there will be no changes to the operation of the bar. There being no further discussion, Mr. Hendrickson moved that THE APPLICATION OF SHAND, LLC (BLUE CRAB BAR), 1909 WEST SUPERIOR STREET, FOR TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE, ON SALE SUNDAY LICENSE AND APPLICATION FOR A 2:00 A.M. BEVERAGE LICENSE, FOR THE PERIOD ENDING AUGUST 31, 2007, WITH BRIAN D SHAND, PRESIDENT AND 60 PERCENT STOCKHOLDER AND JEFFREY SHAND, VICE PRESIDENT AND 40 PERCENT STOCKHOLDER, TRANSFERRED FROM MIDWAY BAR, INC. (MIDWAY BAR), SAME ADDRESS, BE APPROVED AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Anderson seconded the motion and it was unanimously approved.
