RESOLUTION AUTHORIZING THE ACCEPTANCE OF A QUIT CLAIM DEED TO PROPERTY LOCATED IN MILLER CREEK DIVISION FOR USE AS OPEN SPACE AND WETLAND FROM MERIDIAN DULUTH LIMITED PARTNERSHIP.

BY COUNCILOR STAUBER:

     RESOLVED, that the proper city officials are authorized to accept the quit claim deed, a copy of which is on file in the office of city clerk as Public Document No. ____________, from Meridian Duluth Limited Partnership, of the below-described property located in St. Louis County, Minnesota, for open space and wetland purposes at no cost to the city of Duluth:

           Outlots B and C, Miller Creek Division, according to the recorded plat thereof.


STATEMENT OF PURPOSE:  This resolution This resolution authorizes acceptance of a deed to wetland property in the Miller Creek Division, adjacent to the Kohl’s department store, to preserve the property as open space and wetlands.


Conveyance of this property to the city was a condition of acceptance of the plat but it was recently discovered that this conveyance had never occurred. This resolution accepting the deed to the property rectifies this oversight and is required to record the city’s ownership.
