Richard and Cheryl LeBeau, 1124 North 27th Avenue West, Duluth, Minnesota, have submitted to the city council a petition to rezone, from R-1-A (Single Family Residential) to C-5 (Planned Commercial Development), property described as the easterly 550 feet of the southerly 433 feet of the easterly 1,858.11 feet of the S1/2 of the SE1/4, Section 8, Township 50, Range 14, and located on Arrowhead Road west of Rice Lake Road, in the Duluth Heights neighborhood.
Said petition was duly referred to the city planning commission for a study, report and public hearing, at which time the city planning commission subsequently reported its recommendation and approval to the city council, on February 13, 2007 (FN 06112).
The city council wishes to deny this rezoning petition, as they find that the request is inappropriate to protect the comprehensive plan and to conserve and to protect property values in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED, that the petition to rezone the subject property to allow for a C-5 zoning is denied based on the following findings:
STATEMENT OF PURPOSE: This resolution denies rezoning from R-1-A to C-5 the easterly 550 feet of the southerly 433 feet of the easterly 1,858.11 feet of the S1/2 of SE1/4, Section 8, Township 50, Range 14 on the north side of Arrowhead Road West of Rice Lake Road.
PROPERTY LOCATION: 5.5 acres on north side of Arrowhead Road west of Rice Lake Road, in the Duluth Heights neighborhood.
