RESOLUTION AUTHORIZING THE ACCEPTANCE OF FREE CONVEYED PROPERTY LOCATED IN ENDION DIVISION OF DULUTH FOR PUBLIC PURPOSES.

BY COUNCILOR JOHNSON:

     RESOLVED, that the proper city officials are hereby authorized to accept for public purposes, specifically for sanitary sewer and Lakewalk purposes, from the Minnesota department of transportation the real property located in St. Louis County, Minnesota, described as follows:

           Lots 1 through 8, inclusive, Block 8, and Lots 1 through 6, inclusive, BLOCK 10, ENDION DIVISION OF DULUTH, including the easterly 1/2 of vacated 18th Avenue East.


STATEMENT OF PURPOSE:  This resolution will allow the acceptance of a parcel of property from the Minnesota department of transportation to be used for the planned sanitary sewer overflow storage facility in East Duluth.


As councilors are aware, the city is under orders from the MPCA and EPA to eliminate the discharge of sanitary sewage into Lake Superior occurring during periods of overload in the system caused by heavy precipitation and its infiltration into the sanitary sewer system. In order to comply with these requirements for the Lakeside interceptor (Overflow Point No. 13), the city has proposed the construction of major holding facilities which would allow the excess sewer flow to be stored and then fed into the system as capacity allows. One of these facilities will be located on the subject property.


The lots in question are located between Water Street and Lake Superior near 18th Avenue East. The city can acquire these lots for public use by way of a free conveyance. They would then be incorporated into a new sanitary storage facility and integrated into the existing WLSSD sewer lift station. This location was studied and identified in the sanitary sewer overflow facility plan which was approved by the council on May 8, 2006.
