RESOLUTION AUTHORIZING PUBLIC CONSUMPTION OF ALCOHOLIC BEVERAGES ON SUPERIOR STREET AND FIRST STREET IN CONJUNCTION WITH GREATER DOWNTOWN COUNCIL COMMUNITY EVENTS.

BY COUNCILOR LITTLE:

     BE IT RESOLVED, that pursuant to Section 8-22(b) of the Duluth City Code, the Duluth City Council hereby authorizes consumption of alcoholic beverages in public places on Superior Street between Third and Fourth avenues West on June 14, 2007, from 4:00 p.m. to 8:00 p.m., between First and Second avenues West on June 28, 2007, from 4:00 p.m. to 8:00 p.m., between Second and Third avenues West on July 12, 2007, from 4:00 p.m. to 8:00 p.m., between Lake Avenue and First Avenue East on July 26, 2007, from 4:00 p.m. to 8:00 p.m., between Lake Avenue and First Avenue West on August 9, 2007, from 4:00 p.m. to 8:00 p.m., and between First and Second avenues East on August 23, 2007, from 4:00 p.m. to 8:00 p.m. in conjunction with Rock the Block events, on First Street between First and Second avenues West and between Third and Fourth avenues West on July 13, 2007, from 6:00 p.m. to 12:00 a.m., and on Superior Street between Third and Fourth avenues East on July 14, 2007, from 6:00 p.m. to 12:00 a.m. in conjunction with the Downtown Sidewalk Days, provided that all alcoholic beverages consumed outside of designated serving areas of licensed establishments be consumed only from paper or plastic cups.

     BE IT FURTHER RESOLVED, that the dates of this authority may be amended, in the case of inclement weather, if requested in writing by the licensee and approved by the administration.


STATEMENT OF PURPOSE: This resolution waives the drinking in public prohibition for events in conjunction with Downtown Sidewalk Days and Rock the Block events. Such waiver for special events is authorized by Section 8-22(b) of the City Code and is requested by the police department after consultation with the Greater Downtown Council to eliminate the law enforcement problem of having to take action against persons wandering beyond the designated service areas with drinks. For safety purposes, all alcoholic beverages consumed in these areas will have to be in paper cups.
