AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 38, AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM R-1-B, ONE- AND TWO-FAMILY RESIDENTIAL TO C-1, COMMERCIAL, PROPERTY AT THE SOUTHWEST CORNER OF WOODLAND AVENUE AND NORTON STREET (CAROL ANDERSON).

The city of Duluth does ordain:
Section 1. That Plate No. 38 of the zoning district maps as contained in the Appendix to Chapter 50 of the Duluth City Code 1959, as amended, is amended to read as follows:

Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.

STATEMENT OF PURPOSE: This zoning ordinance amendment reclassifies R-1-b, Single-Family Residential, to C-1, Commercial, property located at the southwest corner of Woodland Avenue and Norton Street.
The Duluth city planning commission unanimously approved this zoning change following a public hearing held July 10, 2007. The commissioners based their recommendation on the following:
1. Commercial uses are best located on arterial streets with transit facilities and Woodland Avenue fills that description.
2. The proposed C-1 district would be an expansion of an existing C-1 district located on both the north and east side of the site.
3. The proposed C-1 district expansion is compatible with the comprehensive plan future land use recommendation of “Neighborhood Commercial” future land use. The comprehensive plan recognized that there is a need for additional businesses near the UMD campus to conveniently serve those people living and working there.
