RESOLUTION DENYING A REZONING PETITION TO PROVIDE FOR THE RECLASSIFICATION FROM R-1-B, ONE- AND TWO-FAMILY RESIDENTIAL, TO C-1, COMMERCIAL, PROPERTY AT THE SOUTHWEST CORNER OF WOODLAND AVENUE AND NORTON STREET (CAROL ANDERSON).

BE IT RESOLVED, that the petition to rezone the subject property located at 1535 Woodland Avenue to allow for C-1, Commercial District, (FN 07066) is denied based on the following findings:

STATEMENT OF PURPOSE: This resolution is a counter action to Ordinance 07-046-O and denies the petition for a zoning change from R-1-B, One- and Two-Family Residential, to C-1, Commercial District, for property located at 1535 Woodland Avenue.
The Duluth city planning commission voted 8-0-1 to APPROVE this zoning change following a public hearing held July 10, 2007.
In recommending approval of the zoning change the commission made the following findings of fact:
1. Commercial uses are best located on arterial streets with transit facilities and Woodland Avenue fills that description.
2. The proposed C-1 district would be an expansion of an existing C-1 district located on both the north and east side of the site.
3. The proposed C-1 district expansion is compatible with the Comprehensive Plan future land use recommendation of “Neighborhood Commercial” future land use. The Comprehensive Plan recognized that there is a need for additional businesses near the UMD campus to conveniently serve those people living and working there.
