The city of Duluth does ordain:
Section 1. That Plate No. 29 of the zoning district map as contained in the appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

Section 2. That this ordinance shall take effect 30 days after its passage and publication.
STATEMENT OF PURPOSE: This zoning ordinance amendment provides a zoning change from R-1-b to R-2 for four lots legally described as Lots 17, 19, 21 and 23, Block 154, Duluth Proper Third Division. These lots are currently vacant and are located at the northeast corner of East Tenth Street and North First Avenue East. Applicant states the purpose of this request is to construct townhouses.
The Duluth city planning commission voted to APPROVE this zoning change following a public hearing held August 14, 2007, by a 8 to 0 vote.
In recommending approval of the zoning change the planning commission made the following findings of fact:
1. Conforms to the recently adopted comprehensive plan;
2. Rezoning is compatible with zoning to the north and south.
