RESOLUTION DENYING AMENDING CHAPTER 50 OF THE DULUTH CITY CODE, 1959, AS AMENDED, ZONING DISTRICT MAP NO. 29 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM R-1-B, ONE FAMILY RESIDENTIAL, TO R-2, TWO FAMILY RESIDENTIAL, PROPERTY LOCATED AT EAST TENTH STREET AND NORTH FIRST AVENUE EAST (TERRY HAUER).

BY COUNCILOR STAUBER:

     RESOLVED, that the petition to rezone the subject property located at East Tenth Street and North First Avenue East to allow for R-2, Two Family Residential District (FN 07091), is denied based on the following findings:

STATEMENT OF PURPOSE:  This resolution is a counter action to Ordinance 07-055-O and denies the petition for a zoning change from R-1-b to R-2 for four lots legally described as Lots 17, 19, 21 and 23, Block 154, Duluth Proper Third Division. These lots are currently vacant and are located at the northeast corner of East Tenth Street and North First Avenue East. Applicant states the purpose of this request is to construct townhouses.


The Duluth city planning commission voted to APPROVE this zoning change following a public hearing held August 14, 2007, by a 8 to 0 vote.


In recommending approval of the zoning change the planning commission made the following findings of fact:

     1.   Conforms to the recently adopted comprehensive plan;

     2.   Rezoning is compatible with zoning to the north and south.
