RESOLVED, that the petition to rezone the subject property located within the Second Rearrangement of Airpark Division and Plat of Airpark Division to allow for M-1, Manufacturing, is denied based on the following findings (Planning and Development Department File 07124):

STATEMENT OF PURPOSE: This resolution is a counter action to Ordinance 07-072 and denies the petition for a zoning change from S and IP to M-1 for property located within the Second Rearrangement of Airpark Division and Plat of Airpark Division.
The Duluth city planning commission voted to approve this zoning change following a public hearing held October 16, 2007, by a 7-0-1 vote following consideration of a 40 acre study for this property.
In recommending approval of the zoning change the planning commission made the following findings of fact in support of the change: the requested zoning is consistent with the comprehensive plan; the Seaway Port authority has protective covenants in place; wetlands are protected by the covenants, as well as state and city regulations; and M-1 zoning is consistent with surrounding land uses and development patterns.
