RESOLUTION TO DENY AMENDING CHAPTER 50 OF THE DULUTH CITY CODE, 1959, AS AMENDED, ZONING DISTRICT MAPS NOS. 26, 27, 32 AND 33 AS CONTAINED IN THE APPENDIX TO CHAPTER 50 TO PROVIDE FOR THE RECLASSIFICATION FROM S, SUBURBAN, AND IP, INDUSTRIAL PARK, TO M-1, MANUFACTURING, PROPERTY LOCATED IN THE SECOND REARRANGEMENT OF AIRPARK DIVISION AND PLAT OF AIRPARK DIVISION (CITY OF DULUTH).

BY COUNCILOR STAUBER:

     RESOLVED, that the petition to rezone the subject property located within the Second Rearrangement of Airpark Division and Plat of Airpark Division to allow for M-1, Manufacturing, is denied based on the following findings (Planning and Development Department File 07124):

STATEMENT OF PURPOSE:  This resolution is a counter action to Ordinance 07-072 and denies the petition for a zoning change from S and IP to M-1 for property located within the Second Rearrangement of Airpark Division and Plat of Airpark Division.


The Duluth city planning commission voted to approve this zoning change following a public hearing held October 16, 2007, by a 7-0-1 vote following consideration of a 40 acre study for this property.


In recommending approval of the zoning change the planning commission made the following findings of fact in support of the change: the requested zoning is consistent with the comprehensive plan; the Seaway Port authority has protective covenants in place; wetlands are protected by the covenants, as well as state and city regulations; and M-1 zoning is consistent with surrounding land uses and development patterns.
