AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE, 1959, AS AMENDED, ZONING DISTRICT MAP NOS. 26, 27, 32 AND 33 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM S, SUBURBAN, AND I-P, INDUSTRIAL PARK, TO M-1, MANUFACTURING, FOR PROPERTY LOCATED WEST OF RICE LAKE ROAD BETWEEN AIRPORT ROAD AND KRUGER ROAD (CITY OF DULUTH).

The city of Duluth does ordain:

     Section 1.  That Plate Nos. 26, 27, 32 and 33 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, are amended to read as follows:

     Section 2.  That this ordinance shall take effect 30 days after its passage and publication.


STATEMENT OF PURPOSE:  This zoning ordinance amendment provides for a zoning change from S, Suburban, and I-P, Industrial Park, to M-1, Manufacturing, for all lots and blocks in the plat of the Second Rearrangement of Airpark Division and Plat of Airpark Division. It includes most of the land located east of Haines Road, north of Kruger Road, west of Rice Lake Road and south of Airport Road. The only exception is some property along Kruger Road.


The Duluth city planning commission considered a 40 acre study of the area and approved this zoning change following a public hearing held October 16, 2007.


In approving the zoning change the commission made the following findings of fact in support of the change: the requested zoning is consistent with the comprehensive plan; the Seaway Port authority has protective covenants in place; wetlands are protected by the covenants, as well as state and city regulations; and M-1 zoning is consistent with surrounding land uses and development patterns.
