RESOLUTION AUTHORIZING A DEVELOPMENT AGREEMENT WITH A&L SMDC EAST, LLC, FOR THE SMDC LAKESIDE CLINIC PROJECT.

     RESOLVED, that the proper city officers are hereby authorized to enter into a development agreement, a copy of which is on file in the office of the city clerk as Public Document No. __________________, with A&L SMDC East, LLC, for the development of a new medical clinic facility with parking and public easements at 46th Avenue East and McCulloch Street.


STATEMENT OF PURPOSE:  The purpose of this resolution is to authorize a development agreement with A&L SMDC East, LLC, for the construction of a new 18,000 square foot medical clinic building along with parking for 94 vehicles and a public pedestrian and view easement from Portman Square to Superior Street, all to be located southeast of the intersection of 46th Avenue East and McCulloch Street, across from Portman Square.


For many years, the property in question was occupied by a commercial and office building which had housed the Old Oberg Pharmacy among other uses and by residential housing. Several years ago, SMDC acquired the commercial/office building and has operated a clinic and pharmacy from it, but the building is not large enough to meet the needs of the community for medical services. In addition, the building was not designed as a medical clinic and as such its use as a clinic was a significant compromise.


A&L has acquired the commercial and residential property and has proposed to construct a clinic facility of at least 18,000 square feet which will be located on the northwesterly portion of the property. In addition, McCulloch Street between 46th and 47th Avenues East will be reconstructed to provide two lanes of traffic and, by utilizing the entire easement, 66 vehicular parking spaces which will be open to the public but, by their nature, will be used substantially by clinic patients during the day. When this portion of the project is substantially completed, the existing clinic building will be demolished and additional parking plus a pedestrian and view easement, providing access from Portman Square to Superior Street, will be developed.


This project has been thoroughly reviewed and approved by the planning commission.
