RESOLUTION AUTHORIZING AN AGREEMENT WITH ST. LOUIS COUNTY AND THE DULUTH AIRPORT AUTHORITY REGARDING THE COMMUNICATIONS TOWER, CERTAIN ANTENNAS AND ASSOCIATED EQUIPMENT AT THE CURRENT 911 COMMUNICATIONS FACILITY SITE.

     RESOLVED, that the proper city officials are hereby authorized to enter into an agreement substantially in the form of that on filed in the office of the city clerk as Public Document No. _______________________, with St. Louis County and the Duluth Airport Authority relating to the county’s transfer of ownership of a communications tower and associated equipment to the City and the lease by the city of certain property located at 4848 Lackland Street, the current 911 communications facility site, upon which the tower and the equipment is located in order to provide for use of the tower and equipment for public safety purposes, any payments required thereunder payable from Fund 100 200 1610 5321.


STATEMENT OF PURPOSE: The purpose of this resolution is to authorize an agreement which will allow the city to utilize the communications tower and associated equipment at the current 911 communications facility site located on property managed by the Duluth Airport Authority. The county has leased the site for a number of years, but will be moving to a new facility located at the Chris Jensen site in the near future. The county owns the communications tower, a microwave antennae and certain other equipment that the City would like to use for public safety purposes for the area including the airport.


The agreement provides for the city to lease the property upon which the tower is located and a portion of a mechanical room which will house associated equipment. There will be no payment of rent, but there may be costs associated with maintenance which costs will be borne by the city. The county agrees to keep in effect the FCC microwave license needed for public safety purposes, but gives ownership of the tower and certain equipment to the city at no cost. In the future, there may be a public utility use for the tower, and that is also contemplated in the agreement.
